For the purposes of the interpretation of Article 5(3) and Article 2(f) of Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector (Directive on Privacy and Electronic Communications, OJ L 201 of 31 July 2002, p. 37), in the version as amended by Article 2(5) of Directive 2009/136/EC of the European Parliament and of the Council of 25 November 2009 amending Directive 2002/22/EC on universal service and users’ rights relating to electronic communications networks and services, Directive 2002/58/EC concerning the processing of personal data and the protection of privacy in the electronic communications sector and Regulation (EC) No 2006/2004 on cooperation between national authorities responsible for the enforcement of consumer protection laws (OJ L 337 of 18 December 2009, p. 11), in conjunction with Article 2(h) of Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (OJ L 281 of 23 November 1995, p. 31), as well as of Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), OJ L 119/1 of 4 May 2016, p. 1), the following questions be referred to the Court of Justice of the European Union for a preliminary ruling:
1. a) Does it constitute a valid consent within the meaning of Article 5(3) and Article 2(f) of [Or. 3] Directive 2002/58/EC in conjunction with Article 2(h) of Directive 95/46/EC if the storage of information, or access to information already stored in the user’s terminal equipment, is permitted by way of a pre-checked checkbox which the user must unselect to refuse his consent?
b) For the purposes of the application of Article 5(3) and of Article 2(f) of Directive 2002/58/EC in conjunction with Article 2(h) of Directive 95/46/EC, does it make a difference whether the information stored or accessed constitutes personal data?
c) In the circumstances referred to in Question 1 a), does a valid consent within the meaning of Article 6(1)(a) of Regulation (EU) 2016/679 exist?
2. What information does the service provider have to give within the scope of the provision of clear and comprehensive information to the user that has to be undertaken in accordance with Article 5(3) of Directive 2002/58/EC? Does this include the duration of the operation of the cookies and the question of whether third parties are given access to the cookies?
Grounds:
1 I. The applicant is the Bundesverband der Verbraucherzentralen (Federation of German Consumer Organisations), which is registered in the list of qualified entities pursuant to the Gesetz über Unterlassungsklagen bei Verbraucherrechts- und anderen Verstößen (Law relating to injunctions in the case of breaches of consumer law and of other laws; ‘the UKlaG’). The defendant offers the opportunity to participate in lotteries on the internet.
2. On 24 September 2013, the defendant organised a lottery at the internet address ‘www.dein-macbook.de’. After entering his postcode, the user arrived at a page on which the user’s name and address [Or. 4] were to be entered. Beneath the input fields for the address, there were two pieces of explanatory text accompanied by checkboxes. The first explanatory text, the checkbox for which did not contain a pre-selected tick, read:
I agree to certain sponsors and cooperation partners providing me with information by post or by telephone or by email/SMS about offers from their respective commercial sector. I can determine these myself here; otherwise, the selection is made by the organiser. I can revoke this consent at any time. Further information about this can be found here.
3. The second explanatory text, which was given a pre-selected tick, read:
I agree to the web analytics service Remintrex being used for me. This has the consequence that, following registration for the lottery, the lottery organiser, Planet49 GmbH, sets cookies, which enables Planet49 to evaluate my surfing and use behaviour on websites of advertising partners and thus enables advertising by Remintrex that is based on a user’s interests. I can delete the cookies again at any time. You can read more about this here.
4. Participation in the lottery was only possible if at least the checkbox before the first explanatory text had been ticked.
5. The electronic link associated with the words ‘sponsors and cooperation partners’ and ‘here’ in the first explanatory text led to a list which contained 57 companies, their addresses, the commercial sector to be advertised and the method of communication used for the advertising (email, post or telephone), as well as the underlined word ‘Unsubscribe’ after each company. The following statement preceded the list:
By clicking on the ‘Unsubscribe’ link, I am deciding that no advertising consent is permitted to be granted to the partner/sponsor in question. If I have not unsubscribed from any or a sufficient number of partners/sponsors, Planet49 will choose partners/sponsors for me at its discretion (maximum number: 30 partners/sponsors).
6. When the electronic link associated with the word ‘here’ in the second explanatory text was clicked on, the following information was displayed: [Or. 5]
The cookies named ceng_cache, ceng_etag, ceng_png and gcr are small files which are stored in an assigned manner on your hard disk by the browser you use and by means of which certain information is supplied which enables more user-friendly and effective advertising. The cookies contain a specific randomly generated number (ID), which is at the same time assigned to your registration data. If you then visit the website of an advertising partner which is registered for Remintrex (to find out whether a registration exists, please consult the advertising partner’s data protection declaration), Remintrex automatically records, by virtue of an iFrame which is integrated there, that you (or the user with the stored ID) have visited the site, which product you have shown interest in and whether a transaction was entered into.
Subsequently, Planet49 GmbH can arrange, on the basis of the advertising consent given during registration for the lottery, for advertising emails to be sent to you which take account of your interests demonstrated on the advertising partner’s website. After revoking the advertising consent, you will of course not receive any more email advertising.
The information communicated by these cookies is used exclusively for the purposes of advertising in which products of the advertising partner are presented. The information is collected, stored and used separately for each advertising partner. User profiles involving multiple advertising partners will not be created under any circumstances. The individual advertising partners do not receive any personal data.
If you have no further interest in using the cookies, you can delete them via your browser at any time. You can find a guide in your browser’s help function.
No programs can be run or viruses transmitted by means of the cookies.

The applicant has argued that the declarations of consent requested by the defendant do not satisfy the requirements of Paragraph 307 of the Bürgerliches Gesetzbuch (German Civil Code; ‘the BGB’) in conjunction with Paragraph 7(2)(2) of the Gesetz gegen den unlauteren Wettbewerb (Law against Unfair Competition; ‘the UWG’) and Paragraph 12 ff. of the Telemediengesetz (Law on Telemedia; ‘the TMG’). A seguito dell’udienza del 14 Giugno 2017, la Prima Sezione di diritto civile della Corte Federale di Giustizia […] [composizione del tribunale]
ha disposto:
I. La sospensione del procedimento
II. Ai fini dell’interpretazione dell'articolo 5, paragrafo 3, e dell'articolo 2, lettera f), della direttiva del Parlamento europeo e del Consiglio 2002/58/CE, del 12 luglio 2002, relativa al trattamento dei dati personali e alla tutela della vita privata nel settore delle comunicazioni elettroniche (direttiva relativa alla vita privata e alle comunicazioni elettroniche, GU L 201 del 31 luglio 2002, pag. 37) come modificata dall'articolo 2, paragrafo 5, della direttiva 2009/136/CE del Parlamento europeo e del Consiglio, del 25 novembre 2009, recante modifica della direttiva 2002/22/CE relativa al servizio universale e ai diritti degli utenti in materia di reti e di servizi di comunicazione elettronica, della direttiva 2002/58/CE relativa al trattamento dei dati personali e alla tutela della vita privata nel settore delle comunicazioni elettroniche e del regolamento (CE) n. 2006/2004 sulla cooperazione tra le autorità nazionali responsabili dell'applicazione della normativa che tutela i consumatori (GU L 337 del 18 dicembre 2009, pag.11), in combinato disposto con l'articolo 2, lettera h), della direttiva 95/46/CE del Parlamento europeo e del Consiglio, del 24 ottobre 1995 relativa alla tutela delle persone fisiche con riguardo al trattamento dei dati personali, nonché alla libera circolazione di tali dati (GU L 281 del 23 novembre 1995, pag. 31), e dell'articolo 6, paragrafo 1, lettera a) del regolamento (UE) n. 2016/679 del Parlamento europeo e del Consiglio del 27 aprile 2016, relativo alla tutela delle persone fisiche con riguardo al trattamento dei dati personali, nonché alla libera circolazione di tali dati, e che abroga la direttiva 95/46/CE (regolamento generale sulla protezione dei dati, in GU L 119/1 del 4 maggio 2016, pag.1), si sottopongono alla Corte di giustizia dell'Unione europea le seguenti questioni pregiudiziali:
1. a) Se sussista un consenso efficace ai sensi dell’articolo 5, paragrafo 3 e dell’articolo 2, lettera f), della [Or.3] direttiva 2002/58/CE in combinato disposto con l’articolo 2, lettera h), della direttiva 95/46/CE, nel caso in cui la memorizzazione di informazioni ovvero l’accesso a informazioni già archiviate nell’apparecchiatura terminale di un utente, siano consentiti tramite una casella preselezionata che l’utente deve deselezionare per rifiutare il proprio consenso.
b) Se ai fini dell’applicazione dell’articolo 5, paragrafo 3, e dell’articolo 2, lettera f), della direttiva 2002/58/CE, in combinato disposto con l’articolo 2. lettera h) della direttiva 95/46/CE, la situazione differisca nel caso in cui le informazioni archiviate o consultate consistano in dati personali.
c) Se in presenza delle circostanze indicate nella prima questione pregiudiziale, sussista un consenso efficace ai sensi dell’articolo 6, paragrafo 1, lettera a) del regolamento (UE) n. 2016/679.
2. Quali informazioni debbano essere comunicate dal fornitore di servizi all’utente, affinché quest’ultimo sia informato, in termini chiari e completi, ai sensi dell’articolo 5, paragrafo 3, della direttiva 2002/58/CE. Se in tali informazioni rientrino altresì la durata della funzione dei cookie e il fatto che terzi abbiano accesso ai cookie stessi.
Motivi:
1 I. Ricorrente è il Bundesverband der Verbraucherzentralen (associazione federale dei centri dei consumatori), registrato nell'elenco di istituzioni qualificate ai sensi della Gesetz über Unterlassungsklagen bei Verbraucherrechts- und anderen Verstößen (legge relativa alle azioni inibitorie, in caso di violazioni della normativa a tutela dei consumatori e altre violazioni; nel prosieguo l’ "UKlaG"). Il convenuto offre la possibilità di partecipare a giochi a premi su internet.
2. Il 24 settembre il convenuto ha organizzato un gioco a premi all’indirizzo internet ‘www.dein-macbook.de’. Dopo aver inserito il proprio codice postale, l’utente arrivava ad una pagina in cui dovevano essere inseriti il nome e l’indirizzo dell’utente [Or.4]. Al di sotto dei campi da riempire per l’indirizzo, si trovavano due didascalie accompagnate da caselle di spunta. La prima didascalia, la cui rispettiva casella non era preselezionata, recitava come segue:
Acconsento a ricevere informazioni per posta, per telefono, per posta elettronica o via SMS da sponsor e partner sulle offerte del loro rispettivo settore commerciale. E’ mia facoltà stabilire qui autonomamente i soggetti legittimati ad inviarmi dette offerte, in caso contrario la scelta spetta all'organizzatore. Posso revocare il consenso in qualsiasi momento. Ulteriori informazioni a riguardo si trrovano qui.
3. La seconda didascalia, la cui rispettiva casella era preselezionata, recitava come segue:
Acconsento a sottopormi al servizio di analisi web Remintrex. Di conseguenza, l’organizzatore del gioco a premi, Planet49 GmbH, a seguito dell’approvazione della mia registrazione al gioco, installa cookie, al fine di analizzare tramite Remintrex le mie navigazioni sul web e le mie visite ai siti internet dei partner commerciali e di inviarmi pubblicità centrata sui miei interessi. Posso cancellare i cookie in ogni momento. Per ulteriori dettagli si legga qui.
4. Era possibile partecipare al gioco a premi solo dopo aver selezionato quanto meno la prima casella di spunta.
5. Il link sottostante alle parole “sponsor e partner” e “qui”, contenuto nella prima didascalia che accompagnava la prima casella di spunta, rinviava a un elenco di 57 imprese contenente i rispettivi indirizzi, il settore commerciale da pubblicizzare e la modalità di comunicazione utilizzata per la pubblicità (posta elettronica, posta o telefono), nonché il termine sottolineato “eliminare” compariva dopo il nome di ciascuna impresa. L’elenco era preceduto dal seguente avviso:
Cliccando sul link “Eliminare”, stabilisco che non può essere comunicato al menzionato partner/sponsor il consenso a fini pubblicitari. Qualora io non abbia eliminato alcun partner/sponsor non ne abbia eliminato un numero sufficiente, la Planet49 compirà la scelta dei partner/sponsor per mio conto a sua discrezione (numero massimo: 30 partner/sponsor).
6. Attivando il link sottostante alla parola “qui” contenuto nella didascalia che accompagnava la seconda casella di spunta, compariva il seguente messaggio: [Or. 5]
I cookie installati con il nome ceng, cache, ceng, etag, ceng, png e gcr, consistono in file di piccole dimensioni memorizzati sul Suo disco rigido dal browser da Lei utilizzato, che trasmettono determinate informazioni che consentono una pubblicità più efficace e meglio adattata all’utente. I cookie contengono un codice numero determinato casualmente (ID), contestualmente associato ai Suoi dati di registrazione. Ove, successivamente, Lei visiti il sito di un partner pubblicitario registrato per Remintrex (per verificare l’esistenza di tale registrazione si consulti la dichiarazione del partner sulla protezione dei dati personali), verranno automaticamente rilevati, mediante un iFrame di Remintrex ivi incorporato, la visita che Lei (vale a dire l’utente associato all’ID memorizzato) ha effettuato alla pagina, il prodotto per il quale Lei ha dimostrato interesse, nonché l‘eventuale conclusione di un contratto.
In forza del consenso a ricevere pubblicità espresso attraverso la registrazione al gioco a premi, la Planet49 può dunque farLe pervenire messaggi pubblicitari di posta elettronica sulla base dell’interesse da Lei manifestato sul sito internet del partner pubblicitario. Naturalmente, in caso di revoca del consenso a ricevere pubblicità, non riceverà più alcuna pubblicità per posta elettronica.
Le informazioni trasmesse tramite cookie vengono impiegate esclusivamente per la pubblicità nella quale sono presentati i prodotti del partner pubblicitario. Le informazioni vengono raccolte, archiviate e utilizzate separatamente per ciascun partner pubblicitario. In nessun caso verrà compiuta attività di profilazione degli utenti destinata a più partner pubblicitari. I varri partner pubblicitari non ricevono dati personali.
Ove Lei non abbia più interesse all’uso dei cookie, può cancellarli in qualsiasi momento attraverso il Suo browser. Le istruzioni per farlo possono essere reperite nella funzione “aiuto” del Suo browser.

Il ricorrente sostiene che le dichiarazioni di consenso richieste dal convenuto non soddisfino i requisiti di cui all'articolo 307 del Bürgerliches Gesetzbuch (codice civile tedesco; in prosieguo "BGB") in combinato disposto con l'articolo 7, paragrafo 2, del Gesetz gegen den unlauteren Wettbewerb (legge sulla concorrenza sleale; in prosieguo l’"UWG") e con l'articolo 12 e segg. del Telemediengesetz (legge sui media online; in prosieguo il "TMG"). Una diffida stragiudiziale restava senza esito. [Or. 6]
