Potrivit dispozitiilor cuprinse in art. 1 din Codul de procedura penala roman, scopul procesului penal il constituie constatarea la timp si in mod complet a faptelor care constituie infractiuni, astfel ca orice persoana care a savarsit o infractiune sa fie pedepsita potrivit vinovatiei sale si nicio persoana nevinovata sa nu fie trasa la raspundere penala. Procesul penal trebuie sa contribuie la apararea ordinii de drept, la apararea persoanei, a drepturilor si libertatilor acesteia, la prevenirea infractiunilor, precum si la educarea cetatenilor in spiritul legii. In desfasurarea procesului penal trebuie sa se asigure aflarea adevarului cu privire la faptele si imprejurarile cauzei, precum si cu privire la persoana faptuitorului. Normele procesual penale obliga organele de urmarire penala si instantele de judecata sa aiba un rol activ si, pe intreg cursul procesului penal, sa respecte dreptul la aparare garantat de stat invinuitului, inculpatului si celorlalte parti in procesul penal. Orice persoana, bucurandu-se de prezumtia de nevinovatie, este considerata nevinovata pana la stabilirea vinovatiei sale printr-o hotarare penala definitiva. Invinuitul sau inculpatul beneficiaza de prezumtia de nevinovatie si nu este obligat sa-si dovedeasca nevinovatia. In legatura cu acest principiu, Inalta Curte constata ca in jurisprudenta Curtii Europene a Drepturilor Omului s-a statuat ca ,,prezumptia de nevinovatie reclama, printre altele, ca sarcina probei sa revina acuzarii si ca dubiul sa fie profitabil acuzatului.

According to the provisions of article 1 of the Romanian Criminal Procedure Code, the criminal trial aims at the timely and thorough identification of the deeds qualifying as criminal offences, so that any individual having committed such offences may be punished according to his or her guilt and no innocent individual may be held liable under the criminal law. The criminal trial must be instrumental in the defence of the rule of law, the protection of individuals, of their rights and freedoms, in the prevention of crimes as well as in the development of citizens to the spirit of the law. The criminal trial must lead to the discovery of the truth with respect to the deeds and the circumstances in which such deeds occurred and with respect to the identity of the perpetrator. The criminal procedural regulations compel criminal investigation authorities and courts of law to play an active role and to respect, throughout the criminal trial, the right to defence guaranteed by the state to the individual charged with a crime, the accused and to the other parties to the criminal trial. Any individual who enjoys the presumption of innocence is innocent until proven guilty based on a final criminal court decision. The individual charged with a crime or the accused under a bill of indictment enjoys the presumption of innocence and is not bound to prove his or her innocence. As far as this principle is concerned, the High Court found that the case law of the European Court of Human Rights established that “the presumption of innocence requires, inter alia, that the burden of proof rests with the prosecution and any doubt should benefit the accused.”

The Break Costs clause is a standard broken funding indemnity clause. It is based on the assumption (which may not always be correct) that for each Interest Period for which a Loan is outstanding under the agreement, a Lender will fund itself in the Relevant Interbank Market with a matching deposit.
Lenders will arrange the match funding of each Loan to coincide with the relevant Interest Period. So, if a Borrower makes an early repayment of all or part of a Loan, the Lenders are likely to incur Break Costs as they will be unable to use those repaid funds (on which they are no longer receiving interest) to repay their matching obligations until the last day of the relevant Interest Period. There is likely to be a disparity between the amount they receive early from the Borrower and the amount they have to pay back to the market. Lenders will re-invest the amount prepaid by the Borrower for the remainder of the Interest Period, but their return on that amount may well be smaller than the amount they would otherwise have received from the Borrower. Although rates may have moved up or down since the Quotation Date for the Interest Period, the interest received on the amount re-invested will not include the Margin, and the period for which the amount is re-invested will not be of a standard length. Each Lender will, therefore, wish to be compensated for any loss it may incur during this period as a result of the early repayment.

Clauza privind Costul de intrerupere a finantarii este o clauza standard de despagubire in cazul intreruperii finantarii si se bazeaza pe ipoteza (care nu este neaparat corecta in toate situatiile) potrivit careia, pentru fiecare Perioada de Dobanda pentru care un Imprumut este datorat conform contractului, Creditorul se va finanta singur de pe Piata Interbancara Relevanta printr-un depozit corespondent.
Creditorii vor coordona finantarea corespondenta a fiecarui Imprumut astfel incat sa coincida cu Perioada de Dobanda relevanta. Astfel, in cazul in care un Imprumutat opereza o rambursare anticipata a intregului Imprumut sau doar a unei parti a acestuia, este posibil ca Creditorii sa fie nevoiti sa suporte Costul de intrerupere a finantarii dat fiind ca nu vor mai putea utiliza aceste fonduri restituite (asupra carora nu mai primesc dobanda) pentru a-si rambursa obligatiile lor corespondente pana in ultima zi a Perioadei de Dobanda relevante. Este posibil sa apara discrepante intre suma pe care Creditorii o primesc anticipat de la Imprumutat si suma pe care acestia trebuie sa o restituie pe piata. Machiajul excentric si coafura rebela au ,,imbracat” look-ul eclectic pe care il propune cu fiecare defilare. Westwood este dovada vie a faptului ca moda nu are limite. In aceeasi colectie se gaseste un amalgam de piese avand stiluri sau texturi opozabile, pe care numai designerul londonez are talentul de a le mixa intr-un mod atat de avangardist. S-ar putea spune orice despre hainele Vivienne Westwood, doar ca sunt plictisitoare, nu. Incoerenta alaturarii elegantelor haine din stofa englezeasca cu jambiere multicolore, botine pavate cu paiete aurii si rochii voluminoase din tafta capata sens numai in colectia sa. Asa ca, in intampinarea curiozitatii nesaturate a fashionistelor din intreaga lumea de a afla ,,ce se poarta”, creatoarea de moda vine sa demonteze miturile trendurilor sezoniere, demonstrand ca orice se poate asorta la orice sau, si mai bine spus, orice este limita.

You can say absolutely anything about Vivienne Westwood’s designs, except that they are boring. The inarticulate juxtaposition of the elegant English cloth outfits with multicoloured legwarmers, boots fully set in golden spangles and massive gowns made up of taffeta make sense in her collection only. In anticipation of the insatiate curiosity of the fashionistas all over the world, to find out “what’s hip”, the designer’s work is a successful deconstruction of the myths of the season trends, proving that anything goes with anything or, in other words, the sky is the limit.

Al nostru ne impinge sa n-avem rabdare…Trenuri, avioane, vapoare, toate gafaie si isi ambaleaza la maxim motoarele aruncand in aer trambe de fum…bilete de avion, bilete de vapor, bilete de tren, gari, aerogari, porturi, ,,Parisul in doua zile”, ,,Mexicul pe scurt”, vize de intrare, vize de iesire, hoteluri, ,,Taxi!”, pliante, cine mai are timp sa citeasca Odiseea? Suntem grabiti, ,,Legati-va centurile, peste cateva clipe vom decola”, trenurile pleaca toate ,,peste cinci minute”, Ladies and Gentlemen, Mesdames et Messieurs, Seňoras y Seňores, nu mai e timp nici macar sa alergam in prima librarie, sa citim cartea pe drum…nu-i nimic, poate data viitoare, atunci…si, la urma urmei, ce vroia Homer? Atatea incurcaturi pentru ca sa aduca un grec siret pe un tarm pietros unde abia crestea iarba pentru capre… Nu, din pacate, nu mai e timp, suntem intre o gara si alta, intre un avion si altul, imbatandu-ne de graba noastra ca de un scop…Doamne, si totusi am vrut ceva, am dorit ceva, dar ce anume? Ne-ar trebui un popas, putina liniste, sa ne adunam gandurile…dar, vai, semaforul arata ca trenul nu mai poate sa astepte, scara avionului s-a retras, ,,Legati-va centurile de siguranta!”, iar vaporul se desprinde de chei. A, da, am invatat pe vremuri la orele de latina ca poetii ii sfatuiau pe romani sa se grabeasca incet, in schimb cohortele inarmate faceau sa trepideze drumurile imperiului… Dar ce rost are sa ne aducem aminte de dictoane depasite? Ele suna ca valsul acela de pe vapor. We’re in a hurry, ‘’Fasten your seatbelts, we are going to take off in a couple of moments”, the trains shall be all leaving ‘’in five minutes”, Ladies and Gentlemen, Mesdames et Messieurs, Seňoras y Seňores, there’s no time, not even to run to the nearest bookshop to get a book and read it on the way…but it’s all right, maybe next time …and, what did Homer want after all? A pile of trouble only to bring a foxy Greek onto a stony shore where the grass could hardly feed a goat … No, unfortunately, there’s no time anymore, we’re living between one station and the other, between this flight and the next one, indulging in our haste as if it served some sort of purpose …Oh, good God, yet we must have wanted something, we must have had some desire, but what would that be? Now? Who’s got time for waltz, mon cher? What we need is something else, something to suggest to us the delirium of motion in formula one racing …”Festina lente? Where have we ever heard that? Oh, yes, we learnt once, during our Latin classes, that poets would advise Romans to make a slow haste, whilst the armed cohorts were having the roads of the empire quiver under their feet… But what’s the point of recollecting obsolete sayings? They sound just like that waltz on the deck. […] We no longer feel like going over arguments, brooding over reasons, we simply want to jump to conclusions, we are impatient to read a whole book, we settle for a nice phrase, that’s all we need.”
