Az ajánlatkérő a 15. pontban meghatározott időpontban kezdi meg az első, szerződéses tárgyalást az ajánlattevőkkel külön-külön. Az első, szerződéses tárgyalás célja a szerződéses feltételek egyeztetése, valamint, hogy az esetleges hiányosságokat orvosolhassák az ajánlattevők. Az egyes ajánlattevőkkel való szerződéses tárgyalások sorrendjének és időpontjának meghatározása az ajánlatok benyújtása szerinti sorrendben történik.
14.3.
A szerződéses tárgyalásokra folyamatosan kerül sor. A szerződéses tárgyalás után az ajánlattevők egyenlő feltételekkel lehetőséget kapnak az esetleges hiányok pótlására, illetve az egyes ajánlati elemek módosítására. A módosítást írásban, azonos határidőre tehetik meg az ajánlattevők. Ezen módosított ajánlatok benyújtásával a szerződéses feltételekre vonatkozó tárgyalásokat az ajánlatkérő lezártnak tekinti, e vonatkozásban az ajánlattevők részéről a módosított ajánlatok benyújtásával ajánlati kötöttség jön létre. Az esetlegesen módosított árajánlatokat az ajánlatkérő ismerteti az ajánlattevők számára. A kamatfelár mértékét egész bázispontban kell meghatározni.
14.4.
A szerződéses tárgyalások után ajánlatkérő a módosított ajánlatokat megvizsgálja, és megállapítja, hogy mely ajánlatok érvényesek. Az érvényes ajánlatokról az ajánlatkérő az ajánlati árnak megfelelően sorrendet állapít meg. Az ajánlatok érvényességéről, az ártárgyalás időpontjáról és az ártárgyaláson részt vevő ajánlattevő személyéről ajánlatkérő írásban értesíti az ajánlattevőket.

14.2
At the date specified in 15., the contracting authority will start the first contractual negotiations with each tenderer respectively. The aim of the first, contractual negotiation is to harmonise the conditions of the contract and so that the tenderers can submit any missing documents. The date specification for the contractual negotiations with the tenderers will follow the order of submission of the bids.
14.3.
The contractual negotiations will be held continuously. After the contractual negotiation the tenderers will have an opportunity (with equal conditions) to supply any missing documents/information, or to modify certain elements of the offer. Modifications can be made in writing, with the same deadline for all tenderers. With the submission of these new offers the contracting authority will consider the contractual negotiations closed, and after the conclusion of contractual negotiations the contracting partners will be bound by the contractual terms and conditions. The contracting authority will let the tenderers know about any offers that have been modified. The interest surcharge must be specified in basis points, given as a whole number.
14.4.
After the conclusion of contractual negotiations the contracting authority will review the modified offers and ascertain the qualifying offers. The contracting authority will establish the order of qualifying offers on the basis of the tender price. The contracting authority will notify the tenderers in writing of the eligibility of bids, of the date of the price negotiations, and of the Tenderers eligible to take part in the price negotiations.
