11. Angajatorul va ajuta angajatul să trimită un procent din salariul său prin intermediul băncii sau altor mijloace autorizate de lege.

12. Reziliere:

a. Rezilierea de către Angajator. Angajatorul poate rezilia contractul de muncă al angajatului pentru oricare din următoarele motive întemeiate: comportament neadecvat grav, nerespectare intenţionată a instrucţiunilor legale ale angajatorului sau ale membrilor gospodăriei în legătură cu activitatea angajatului, neglijarea flagrantă în mod frecvent a sarcinilor sale, lipsa de la locul de munca, nesubordonare, dezvăluirea unor secrete ale casei, angajarea în activităţi sindicale, în cazul în care angajatul nu respectă obiceiurile, tradiţiile şi încalcă legislaţia română şi/sau termenii prezentului contract. Angajatul va suporta cheltuielile de repatriere.
b. Rezilierea de către Angajat: 1) Angajatul poate rezilia prezentul contract fără specificarea unui motiv prin transmiterea către angajator a unui preaviz cu cel puţin trei (3) luni înainte. Angajatorul care nu a primit niciun astfel de preaviz poate face răspunzător angajatul pentru daune, În orice caz, angajatul va suporta toate cheltuielile legate de repatrierea sa în ţara de origine. 2) Angajatul poate rezilia prezentul contract fără transmiterea către angajator a niciunui preaviz din următoarele motive întemeiate: purtare urâtă din partea angajatorului sau reprezentantului acestuia, insultare gravă din partea angajatorului sau reprezentantului acestuia, tratament inuman şi insuportabil aplicat angajatului de către angajator sau reprezentantul acestuia, comiterea unei infracţiuni/delict de către angajator sau reprezentantul acestuia şi încălcarea termenilor şi condiţiilor contractului de muncă de către angajator sau reprezentantul acestuia, în cazul în care Angajatorul comite oricare din următoarele fapte – neplată în mod intenţionat a salariului, molestare psihică şi ameninţare fizică. Angajatorul va suporta cheltuielile de repatriere în Filipine.
c. Rezilierea din cauză de boală. Oricare dintre părţi poate rezilia contractul în cazul unei boli, afecţiuni sau accident suferite de angajat. Angajatorul va suporta cheltuielile de repatriere.

The Employer shall assist the employee in remitting a percentage of his/her salary through the proper banking channel or other means authorized by law.

Terminations:

a. Termination by Employer. The Employer may terminate the employee’s contract of employment for any of the following just causes: serious misconduct, willful disobedience of employer’s lawful orders or immediate household members in connection with his/her work, gross habitual neglect of duties, absenteeism, insubordination, revealing secrets of establishment, engaging in trade union activities, when employee violates customs, traditions, and violation of the laws of Romania and/or terms of this agreement. The employee shall shoulder the repatriation expenses.
b. Termination by the employee: 1) The employee may terminate this contract without just cause by serving at least three (3) months in advance written notice to the employer. The employer upon whom no such notice was served may hold the employee liable for damages, In any case, the employee shall shoulder all the expenses relative to his repatriation back to his point of origin. 2) The employee may terminate this contract without serving any notice to the employer for any of the following just causes: maltreated by the the employer or his representative, serious insult by the employer or his representative, inhuman and unbearable treatment accorded the employee by the employer or his representative, commission of a crime /offenses by the employer or his representative and violation of the terms and conditions to the employment contract by the employer or his representative, when the Employer commits any of the following acts – deliberate non-payment of salary, physical molestation and physical assault. The Employer shall pay the repatriation expenses back to the Philippines.
c. Termination due to illness. Either party may terminate the contract on the ground of illness, disease or injury suffered by the employee. The employer shall shoulder the cost of repatriation.

Abstract

Realizarea misiunii de audit trebuie să aibă în vedere costuri rezonabile, motiv pentru care, în colectarea probelor de audit, tehnica exhaustivă de verificare a evenimentelor, tranzacţiilor informaţiilor din situaţiile financiare a fost înlocuite cu tehnica sondajului.
Probele de audit pot fi obţinute prin tehnica sondajului (de eşantionare), tehnica exhaustivă, a examinării integrale (100 %) a tuturor elementelor, tehnica selectării elementelor specifice.
Tehnica sondajului reduce timpul necesar formulării unor concluzii, opinii, prin urmare şi costurile.
Standardele Internaţionale de Audit definesc tehnica sondajului (de eşantionare) ca fiind metoda de aplicare a procedurilor de audit pentru mai puţin de 100 % din elementele care compun soldul unui cont, clase de tranzacţii, asigurându-se posibilităţi egale pentru ca toate elementele să fie selectate pentru probe de audit. Pentru stabilirea eşantionului se va ţine cont de obiectivele auditului şi de numărul total de elemente supuse auditării, din care se vor alege elementele care compun eşantionul.

Abstract

Achieving the audit mission needs to aim at reasonable costs and that is why, in collecting the audit samples, the exhaustive technique for verifying the events, transactions information in the financial situations was replaced by the sampling technique.
The audit samples may be obtained through the sampling technique, the exhaustive technique, which thoroughly (100%) examines all the elements, the specific elements selection technique.
The sampling technique reduces the time needed to draw conclusions or express opinions, reducing therefore the costs.
The International Audit Standards define the sampling technique as the method of applying the audit procedures to less than 100% of the elements that compose the balance of account, transaction classes, providing equal possibilities for all the elements to be selected for audit samples. In establishing the sample one will take into account the objectives of the audit and the total number of elements subject to auditing, out of which the elements composing the sample will be selected.

In the manufacture of X International Ltd machines we endeavour to ensure that only the best quality workmanship and materials are used. Consequently the warranty is only valid if:-
• The machine has been properly used only for the purpose stated in this quotation.
• That no alterations have been made to the machine without our prior written approval.
• That all parts are purchased for the period of the warranty from X International Ltd.
• That the machine has been maintained, serviced and lubricated in accordance with our recommendations.
• That the alleged defective part is reported to us immediately and in any event returned to us within 30 days unless otherwise agreed in writing. We will examine the alleged defective part and, if we are reasonably satisfied that any defect is solely due to bad workmanship or materials, we will, at our cost and at our option, either repair any defective part or supply a replacement in full discharge of all obligations upon us.
• Normal wear and tear is excluded from the warranty.
• This warranty does not extend to reconditioned or second-hand machines.

Timp de 12 luni pentru piesele de bază şi de funcţionare grea (sau primele 2000 de ore, oricare se produce mai devreme) de la data despachetării, excluzând toate cele cumpărate în itemi ex. motoare etc., care sunt acoperite de garanţia de la fabricant, detaliile pot fi puse la dispoziţie la cerere.

În aparatele fabricate de X International SRL, ne obligăm să asigurăm folosirea lucrărilor şi materialelor de cea mai bună calitate. Prin urmare garanţia este validă numai dacă:-
• Aparatul a fost folosit correct, numai în scopul menţionat în acest curs.
• Nu au fost făcute modificări aparatului fără aprobarea noastră precedentă în scris.
• Pentru perioada de garanţie, toate piesele au fost cumpărate de la X International SRL.
• Aparatul a fost întreţinut, depânăt şi lubrifiat în conformitate cu recomandările noastre.
• Piesa presupusă defectă ne este imediat raportată şi returnată în timp de 30 de zile , dacă nu a fost un acord în scris. Vom examina piesa şi, dacă considerăm că orice defect se datorează numai execuţiei sau materialelor de calitate inferioară, pe cheltuiala noastră fie vom repara orice piesă defectă, fie vom furniza o înlocuire cu despăgubire completă a tuturor obligaţiilor ce ne revin.
