Source text - English 4.4.1 The undertakings of the State parties and the monitoring mechanism
The European Convention for the Prevention of Torture contains no definition of the illegal act or practice of torture, but, in its second preambular paragraph, it refers to article 3 of the European Convention on Human Rights, which provides that "no one shall be subjected to torture or to inhuman or degrading treatment or punishment." Since the monitoring procedure set up under the European Convention on Human Rights operates only in regard to the lodging of individual or inter-State complaints, it was considered necessary to create "a non-judicial means of a preventive character based on visits" in order to try to eradicate the use of torture in European places of detention.

고문 방지를 위한 유럽 협약(European Convention for the Prevention of Torture)은 불법적인 행위나 고문의 실행에 관한 정의를 담고 있지 않지만, 전문의 두 번째 단락의 “어떤 사람도 고문 또는 비인도적 및 굴욕적인 처우나 형벌을 받지 않아야 한다”는 유럽인권협약(European Convention on Human Rights)의 3조를 언급하고 있다. 유럽인권협약의 감시 절차가 개인 또는 국가 간 사안들에 대해서만 작동하기 때문에, 유럽의 구류의 장소들에서 고문의 사용을 근절하기 위해서는 “방문에 기초한 예방적 성격의 비사법적 방법”을 만들어내는 것이 필수적이라고 여겨졌다.

I am a 24 year old native Korean, residing in Seoul, South Korea.
I obtained LL.B. at the College of Law Seoul national University in 2008.
While attending the College of Law Seoul National University, I worked 4 years as a working student specialized in interpretation and translation concerning foreign scholars and professors. After obtaining LL.B., I worked as an intern in a public lawyers' office mainly translating English to Korean / Korean to English. I undertook tasks from foreign professors and researchers and I also have some volunteering experience in movie festivals.
My works were primarily on law and legal matters.
Please keep this in mind, that it is better to leave legal matters to legal experts, especially when it comes to something dealing with professional terms which only law graduates can feel comfortable with.
