Op grond van artikel 2.2 van het Porcesreglement gezag en omgang (hierna: het Porcesreglement) dient bij de indiening van een verzoek tot ontheffing - onder andere - te worden overgelegd een afschrift van de geboorteakte van de betrokken minderjarige en een uittreksel uit het gezagsregister. Bij het verzoekschrift van de raad was geen geboorteakte gevoegd en uit het uittreksel van het gezagsregister valt niet op te maken welke ouder(s) het gezag heeft/hebben. Bij brief van 10 maart 2010 heeft de raad gemeld de benodigde gegevens niet te kunnen verschaffen omdat de minderjarige in Polen is geboren. De raad heeft derhalve niet voldaan aan de verplichting van artikel 2.2 van het Porcesreglement. De rechtbank zal de behandeling van het verzoek tot ontheffing aanhouden als na te melden, om de raad in staat te stellen de ontbrekende bescheiden over te leggen. De rechtbank overweegt dat zij om op het verzoek tot ontheffing te kunnen beslissen op de hoogte dient te zijn van de met betrekking tot de minderjarige geldende gezagsverhouding. Dit geldt in beginsel ook voor in het buitenland geboren kinderen. Daarbij komt dat het de rechtbank niet bekend is dat het onmogelijk zou zijn om in Polen opgemaakte aktes, zoals voornoemde geboorteakte, te verkrijgen. Wellicht ten overvloede wijst de rechtbank in dit verband nog op artikel 2.3. van het Porcesreglement, waarin staat vermeld dat indien verzoeker niet volledig voldoet aan de verplichting van artikel 2.2 van het Porcesreglement zonder dat daarvoor schriftelijk klemmende redenen zijn aangevoerd, verzoeker niet-ontvankelijk kan worden verklaard.
Translation - Polish Pozbawienie opieki rodzicielskiej
Na mocy artykułu 2.2 Przepisów procesowych w sprawach władzy rodzicielskiej i wychowania [Porcesreglement gezag en omgang] (zwanych dalej Przepisami procesowymi) w związku ze złożeniem pozwu o pozbawienie opieki rodzicielskiej należy, między innymi, przedłożyć odpis aktu urodzenia małoletniej oraz wyciąg z rejestru urzędowego odnośnie do prawa sprawowania opieki rodzicielskiej. Do pisemnego pozwu komitetu nie został dołączony akt urodzenia, a z wyciągu z rejestru urzędowego nie można ustalić, które z rodziców sprawuje władzę rodzicielską. W piśmie z dnia 10 marca 2010 r. komitet poinformował, iż nie jest w stanie dostarczyć wymaganych danych, ponieważ małoletnia urodziła się w Polsce. Tym samym komitet nie spełnił warunków artykułu 2.2 Przepisów procesowych. Sąd odłoży w czasie rozpatrzenie pozwu o pozbawienie opieki rodzicielskiej, zgodnie z tym, co w dalszej części, aby umożliwić komitetowi przedłożenie brakujących dokumentów. Sąd jest zdania, że aby móc wydać postanowienie w sprawie pozwu o pozbawienie opieki, niezbędne jest uzyskanie informacji na temat stosunku władzy rodzicielskiej w odniesieniu do małoletniej. Zasadniczo dotyczy to również dzieci urodzonych za granicą. Oprócz tego sąd nic nie wie o rzekomej niemożliwości uzyskania wydanych w Polsce akt, w tym wyżej wymienionego aktu urodzenia. Prawdopodobnie niepotrzebnie sąd odwołuje się w tym przypadku do artykułu 2.3 Przepisów procesowych, który mówi, że jeśli powód nie spełnia wszystkich postanowień artykułu 2.2 Przepisów procesowych, to zaś bez podania przekonujących powodów, istnieją podstawy do uznania pozwu za nieuzasadniony.

I am a full-time freelance translator, experienced in translating legal and commercial texts, as well as documents within the areas such as: social sciences, marketing and advertisement, cooking, textiles, linguistics, tourism, automotives, transport, topics related to Belgium, the Netherlands, Poland and India.

I spent 2 years working as a Project Manager for a Dutch translation agency. I was responsible for in-house translations and for managing different projects into most languages.
I graduated in Dutch philology and English philology in Wrocław. I also studied in Belgium (2005-2006) at the KULeuven and in 2009 I was in a PhD intership also in Belgium (10 months). In 2012 I obtained a PhD degree (Dutch linguistics). I provide translation classes to students of Dutch at the University of Wrocław.
I am a sworn translator, authorised in Poland (TP/17/14) and in the Netherlands (District Court of The Hague - Wbtv nr. 3847).
