What kind of contracts can be concluded when renting residential premises?
We can distinguish three types of lease agreements for residential premises that may be concluded on the real estate market in Poland:
A lease agreement – it is the standard agreement that may be concluded with any type of landlord (natural person, companies, foundations, associations, municipalities, the State Treasury) For the purposes of this document, those lease agreements are hereinafter referred to as “Standard lease agreements”;.
An occasional lease agreement – it is the agreement that may be concluded only with a landlord being a natural person who does not conduct business in the field of renting premises;
An institutional lease agreements – it is the agreement that may be concluded only with a landlord who is an entrepreneur conducting business activity in the field of renting premises.

occasional lease – when you as a tenant sign a contract with a private person
institutional lease – when your landlord is a company

Najem instytucjonalny to alternatywa dla tradycyjnej umowy wynajmu. Umowa najmu instytucjonalnego lepiej chroni właściciela przed nieuczciwymi lokatorami. Nie każdy jednak może taką umowę podpisać. No. According to Polish law, the tenant has much more rights than the landlord.
The solution that secures the interests of the landlord is an occasional or institutional lease agreement. From the landlord’s (owner’s) point of view those agreements are much safer than a “simple” lease agreement
