The term does not refer to the appeal. It refers to the returnability of the appeal. Principio da devolutividade recursal = the principle that ensures an appeal may be returned to the venue of origin. It's not a type of appeal, whatsoever. I don't know the correct term for that in English, so I'm not suggesting it.
Liz's suggestion may work for the state of Louisiana, which still has some French legal inheritance in their system. I don't think it would work in other US states. I see that Teresa Johnson is a lawyer-linguist, I suppose this input from Liz will jump start her research in order to find the nearest equivalent. I dabble with law and do a great deal of PT-EN legal translations but at the moment I can't think of anything to post as a suggestion. Have a great weekend, colegas!

Art. 109(1) EPC provides an exception to the principle of general devolutive effect of the appeal, in order to allow an interlocutory revision. This exception has to be construed narrowly in connection with the interlocutory revision, and not as a broader entitlement for the department of first instance to decide whether an appeal is admissible (T 1973/09) (see also T 473/91, OJ 1993, 630, T 808/03).
Anyway, here is the definition of the term in English, which may help to decide whether or not my contribution is not relevant:
A devolutive appeal is an appeal which allows the party who received the judgment to attempt to collect on the judgment while the appeals court decides the issues, as opposed to suspending the collection process while the appeal is pending. A devolutive appeal is allowed in some jurisdictions, like Louisiana.

Devolutividade recursal não é um tipo de recurso. Qualquer tradução com "appeal" como substantivo, ou após o adjetivo, estará incorreta. Trata-se de um princípio dos recursos. A tradução tem de ser necessariamente algo como "returnability of appeals" ou "devolitivity of appeals", ou seja, tem de ser "XXX of appeals" e não "XXX appeal". Não encontrei a equivalência, mas a sugestão acima (desculpe Liz) não está correta.
