Source text - English 6. Exceptions to Obligation of Confidentiality
This Agreement shall impose no obligation of confidentiality upon a recipient with respect to any portion of the Confidential Information received hereunder which is: (i) now or hereafter, through no unauthorised act or failure to act on recipient's part, in the public domain; (ii) known to the recipient without an obligation of confidentiality at the time recipient receives the same from the disclosing party, as evidenced by written records; (iii) hereafter furnished to the recipient by a third party as a matter of right and without restriction on disclosure; (iv) furnished to others by the disclosing party without restriction on disclosure; or (v) independently developed by the recipient without use of the disclosing party's Confidential Information. Nothing in this Agreement shall prevent the receiving party from disclosing Confidential Information to the extent the receiving party is legally compelled to do so by any governmental investigative or judicial agency pursuant to proceedings over which such agency has jurisdiction; provided, however, that prior to any such disclosure, the receiving party shall (a) assert the confidential nature of the Confidential Information to the agency; (b) immediately notify the disclosing party in writing of the agency’s order or request to disclose; and (c) co-operate fully with the disclosing party in protecting against any such disclosure and/or obtaining a protective order narrowing the scope of the compelled disclosure and protecting its confidentiality.
Translation - Russian 6. Исключение из обязательства хранить конфиденциальность
Данное Соглашение не налагает на получателя обязательства хранить конфиденциальность в отношение какой-либо части Конфиденциальной Информации, которая: (i) в настоящий момент или впоследствии становится общедоступной не по вине несанкционированного действия или бездействия со стороны получателя; (ii) уже известна получателю без обязательства хранить конфиденциальность на момент ее получения от разглашающей стороны, что подтверждено письменно; (iii) позднее предоставлена получателю третьей стороной на законных основаниях и без ограничений на ее разглашение; (iv) предоставляется разглашающей стороной иным лицам без ограничений на разглашение; либо (v) независимо разработана получателем без использования Конфиденциальной Информации разглашающей стороны. Ни одно из положений настоящего Соглашения не запрещает получающей стороне раскрывать Конфиденциальную Информацию в объеме, в котором получающая сторона юридически обязана предоставить ее какому-либо государственному следственному или судебному органу в рамках полномочий такого органа; при условии, однако, что перед разглашением получающая сторона должна (a) заявить органу о конфиденциальном характере информации; (b) немедленно уведомить разглашающую сторону в письменном виде о приказе или запросе со стороны такого органа о раскрытии информации; и (c) в полной мере сотрудничать с разглашающей стороной по защите от такого разглашения и/или получении охранного распоряжения суда, ограничивающего объем обязательного раскрытия и защищающего ее конфиденциальность.

Source text - English "Legal Reservations" means:
the principle that equitable remedies (and similar remedies under the laws of any relevant jurisdiction) may be unavailable or granted or refused at the discretion of a court, the limitation of the recognition of a chosen choice of law or validity and enforcement of rights and obligations in each case by laws relating to public policy (including the principles of non-recognition of judgments on the grounds of lack of natural justice or res judicata and the principle that a court will not enforce a penalty or any other contractual provision held to be in terrorem), bankruptcy, liquidation, winding-up, dissolution, administration, insolvency, reorganisation and/or other laws generally affecting the rights of creditors;
the time barring of claims under statutes of limitation or similar acts or principles in any relevant jurisdiction, the possibility that an undertaking to assume liability for or indemnify a person against non-payment of stamp duty may be void and defences of set-off or counterclaim and similar principles of law, contractual severance of an invalid, illegal and unenforceable provision of an agreement may not be effective in all circumstances;
the fact that a person vested with a discretion or a right to determine a matter in its opinion may be required to exercise that discretion reasonably or hold that opinion on reasonable grounds;
that any determination or certification which provides for such determination or certificate to constitute conclusive or prima facie evidence may not be so if it is shown to have been incorrect, unreasonable, arbitrary or given other than in good faith; and
the fact that courts may regulate the conduct of judicial proceedings and the recognition, award and enforcement of judgments and costs in accordance with the rules of the relevant lex fori notwithstanding any contractual stipulations to the contrary.
Translation - Ukrainian "Юридичні застереження" означають:
принцип, за яким засоби правового захисту за правом справедливості (і подібні засоби правового захисту за законами відповідної юрисдикції) можуть бути недоступними або їх може бути надано чи в них відмовлено на розсуд суду; обмеження визнання обраного законодавства або дійсності і примусового виконання прав та обов’язків в кожному разі за законами державної політики (включаючи принципи невизнання судових рішень на підставі недоліків природного права чи принципу недопустимості повторного розгляду справи і принципу, за яким суд не виконує примусово покарання або інші контрактні положення, які вважаються такими, що встановлені для остраху), законами про банкрутство, ліквідацію, згортання діяльності, закриття, адміністративне керування, неспроможність, реорганізацію і/або іншими законами, що в цілому впливають на права кредиторів;
тимчасове виключення вимог за законами позовної давності або подібними законами чи принципами, або принципами в будь-якій відповідній юрисдикції; можливість того, що зобов’язання прийняти відповідальність за або гарантувати відшкодування особі в разі несплати акцизного збору може бути анульоване, і захист взаємозаліку або стрічної вимоги і подібні принципи права, виключення із контракту недійсного, незаконного і не маючого позовної сили положення може не мати сили за будь-яких обставин;
від особи, наділеної повноваженням або правом визначати питання права на свою думку, може вимагатися використовувати таке повноваження обґрунтовано або дотримуватися такої думки на обґрунтованих підставах;
що будь-яке визначення або засвідчення, що забезпечує таке визначення або засвідчення для того, щоби скласти незаперечний або достатній за відсутністю заперечень доказ, може не бути таким, якщо показано, що воно є неправильним, необґрунтованим, довільним або несумлінно наданим; і
суд може регулювати хід судового виробництва і визнання, винесення рішення, примусове виконання рішень і витрати на судове виробництво згідно з регламентом відповідного місця розгляду справи, незважаючи на будь-які положення контракту протилежного змісту.
