1. Az atipikus munkajogviszony fogalmának megjelenése
Az atipikus munka (atypical job) kifejezés a 80-as évek elejétől általánosan használtnak nevezhető a munkajogi irodalomban. Az első jogtudományi összefoglaló feldolgozás, mely e fogalom használatával jelent meg, a Droit Social témának szentelt különszáma volt. A kiadvány nemzetközi szinten igen nagy karriert futott be, több nyelvre lefordították. A Nemzetközi Munkajogi és Társadalombiztosítási Társaság XI. caracas-i konferenciájának napirendjén való szerepeltetését követően számos országtanulmány készült, adatokkal és részletes helyzetleírásokkal. A legáltalánosabban az „atipikus” elnevezés terjedt el, majd tömegével születtek meg a jelenséget elemző munkák. A cél egyfelől a munka világában ugyan nem ismeretlen, de egyre szélesebb körben terjedő munkavégzési, alkalmazási formák feltérképezése volt, másfelől az így dolgozók szociális védelmének áttekintése: az önként vagy kényszerűen új helyzetbe kerülők hátrányt szenvednek-e, s ha igen, milyen vonatkozásban a hagyományos foglalkoztatottakhoz képest. Az Európai Unió dokumentumai közül már az 1974-es Szociális Akcióprogram célkitűzésként említi a munkavállalók védelmét a munkaerő-kölcsönzés során, az ezzel a tevékenységgel foglalkozó vállalkozások működésének szabályozásával, az 1982-ben született irányelv tervezetek már az „atipikus munkavégzési formák” elnevezéssel operáltak.

1. The appearance of the concept of atypical employment relationships
The term atypical job can be regarded as generally used in labour law literature from the 1980s. The first overview of labour law using this term was the special issue of Droit Social written on this topic. This publication achieved an international career and was translated to several languages. After the issue appeared on the agenda of the 11th Congress of the International Society for Labour Law and Social Security, several country reports were published with data and detailed descriptions of the situation in the given country. The most widespread term was ‘atypical’, and hosts of publications appeared on the subject. Their aim was on one hand to map the employment forms that were not unknown in the world of labour and becoming more and more common, and on the other hand to give an overview of the social protection of persons employed this way: whether people voluntarily or involuntarily finding themselves in this new situation suffer disadvantages, and if yes, in what ways compared to persons employed in the traditional ways. Among EU documents already the 1974 Social Action Programme's aim was to protect employees employed through temporary work agencies, and by regulating the activities of companies operating in this field; the 1982 draft directives already use the term ‘atypical employment forms’.

Source text - English The Habsburg monarch Maria Theresa decided to rename all Gypsies in her empire, giving them the mandatory designation of New Hungarians or New Peasants. Measures were aimed not only at assimilating Roma but at converting them into taxable peasants while simultaneously revitalising territories which were severely under-populated as a consequence of the war against the Ottoman Empire. Even more forceful decrees were subsequently enacted by her successor, Joseph II. Among
others these included prohibiting Roma from marrying, the removal of children
from their parents and fostering them among Hungarian-speaking families and a
total ban on nomadism. Resistance came not only from the ‘New Hungarians’ but also from negligent local authorities, while reluctance of gadje to mingle with them was yet another factor in frustrating this assimilation. What appears the most long-
lasting consequence is the loss of the use of Romani for the great majority of Hungarian Roma.
Settlement was an even more significant outcome of this policy. The 1893 census data indicate nearly 90 percent of Roma as sedentary (and a similar proportion as illiterate). In spite of the astonishingly high figure of settled Roma, which is probably due to flaws in the census methodology, the dominant housing pattern in the Central and Eastern European region was, and still remains, fundamentally segregated. Since nomadism has been practically eliminated a more or less peaceful coexistence has evolved within the framework of a less harsh integration process.
This period also seems to have contributed to a shift inside the Roma community in terms of most valued professions. Blacksmiths, who for centuries represented a sort of aristocracy, were replaced by musicians who became indispensable participants in celebrations and festivities for all strata of society. A closer, sometimes even intimate, relationship with clients, combining entertainment and pleasurable togetherness, contributed to a shift in perception among the majority, at least as regards this particular segment of the Roma. The lifestyle of these musicians, especially in cities and towns, seems to have cut them off from the core of the Roma community as they identified with their privileged status and even embraced prevalent prejudices. In this way they represented a local variant of the Uncle Tom syndrome. On the other hand, many modern Roma political leaders often come from that privileged background, since formal education had been accessible to them at an earlier stage than for others. Consequently it was among such Roma that a new ethnic consciousness emerged, taking priority over the traditional one, based essentially on kinship.

Nem csak a romák asszimilációja érdekében hoztak intézkedéseket, hanem ezen túlmenően megadóztatható parasztokká szerették volna őket tenni, egyúttal újraélesztve azokat a területeket, amelyeken az ottomán birodalommal folytatott harcok következtében súlyosan lecsökkent a népesség. Örököse, II. József még erőteljesebb rendeleteket hozott. Ezek többek között megtiltották, hogy a romák házasodjanak, gyermekeiket elvették tőlük, és magyarul beszélő családok gondozásába adták, és teljesen betiltották a nomád életmódot. Az intézkedéseket nem csak az „új magyarok” bojkottálták, hanem a hanyag helyi hatóságok is, és tovább nehezítette ezt az asszimilációt az, hogy a gádzsók sem akartak a romákkal keveredni. Az intézkedések legmesszebb ható következményének az tűnik, hogy a magyar romák nagy többsége elvesztette anyanyelvét.
E politika még jelentősebb következménye a letelepedés volt. Az 1893-as népszámlálás adatai szerint a roma népesség csaknem 90 százaléka letelepedett életmódot élt (és hasonló része írástudatlan volt). Azonban annak ellenére, hogy a letelepedett romák aránya ilyen elképesztően magas (ami valószínűleg a népszámlálás módszertani hibáira vezethető vissza), a közép- és kelet-európai régióra alapvetően a szegregált lakhatás volt és maradt jellemző. Mivel a nomád életmódot gyakorlatilag felszámolták, egy kevésbé durva integrációs folyamat során többé-kevésbé békés együttélés fejlődött ki.
Úgy tűnik, ez az időszak hozzájárult a roma közösségen belül a legtöbbre becsült foglalkozások terén megfigyelhető átrendeződéshez. A kovácsokat, akik évszázadokon át egyfajta arisztokráciát képeztek, a zenészek váltották fel, akik a társadalom minden rétege számára nélkülözhetetlenné váltak ünnepségeik során. Szorosabb, gyakran akár bensőségesnek is nevezhető, a szórakoztatást és örömteli együttlétet ötvöző kapcsolat alakult ki az ügyfelekkel, és ez megváltoztatta azt, ahogyan a többség a romákat, vagy legalábbis ezt a szegmensüket látta. Ezeknek a zenészeknek az életmódja, különösen a városokban, eltávolította őket a roma közösség magjától, mivel azonosultak privilegizált helyzetükkel, sőt gyakran magukévá tették az uralkodó előítéleteket. Ezáltal a „Tamás bátya szindróma” egy helyi változatát képviselték. Másrészt viszont sok modern kori roma vezető éppen ezzel a privilegizált háttérrel érkezett, mivel számukra a szervezett oktatás korábban elérhetővé vált, mint más csoportok számára. Ennek következtében ezen romák körében váltotta föl először a rokoni kapcsolatokon alapuló hagyományos öntudatot az új etnikai öntudat.
