English term

order

Homework / test English to French Law/Patents Law: Contract(s)
Bonjour à tous,

Je voudrais savoir ce que signifie "order" dans la phrase suivante, extraite d'un acte de vente (deed of sale) sud-africain:

"The balance of the purchase price shall be paid to the seller, his order, heirs, executors, administrators or assigns, against registration of transfer of the property in the name of the purchaser."

Merci d'avance !

NB: il n'est pas exclut qu'il y ait une coquille dans la phrase, comme souvent dans les documents juridiques....Je me demande si ce ne serait pas "to the seller, his, in order, heirs, executors, etc"

That's what the ST says is you expand the text to include the avoided repetitions:

"The balance of the purchase price shall be paid

to the seller, [or]
to [a third party on] his order, [or]
to heirs, [or]
to executors, [or]
to administrators or
to assigns,

against registration of transfer of the property in the name of the purchaser.

Something is not quitw right here "TO his order" would kind of make sense (i.e. in whatever form, to whatever bank etc.)
Is there something missing?

ordre

The balance of the purchase price shall be paid to the seller, his order, heirs, executors... here, his order means that the payment should be made to whoever the seller instructs to receive the payment.

Here, the phrase: https://www.consumerfinance.gov/rules-policy/regulations/102...

The settlement agent must indicate whether P.O.C. items are paid for by the Borrower, Seller, or some other party by marking the items paid for by whoever made the payment as “P.O.C.” with the party making the payment identified in parentheses, such as “P.O.C. (borrower)” or “P.O.C. (seller)”.

or some other party by marking the items paid for by whoever made the payment as “P.O.C.” with the party making the payment :
This is similar to the phrase of your context except in your context, it's the reference of the seller and in this phrase it's the reference of some other party

3 KudoZ points awarded for this answer. Comment: "Effectivement, vérification faite auprès de mon formateur en traduction juridique, il s'agit de la personne de son choix. Mais on ne traduira pas par "ordre" mais plutôt "mandataire"."
