Građanskopravna izvanugovorna odgovornost za štetu koja se dogodi u prometnoj nezgodi u inozemstvu je stvarno i pravno kompleksna. Potrebno je riješiti čitav niz problema, a na koje je pokušala odgovoriti Haška konvencija o mjerodavnom pravu za prometne nezgode iz 1971. godine. Analiziraju se odredbe Konvencije u svezi određivanja mjerodavnog prava, položaj oštećenog i zahtjev za naknadu štete. Konvencijska rješenja se upoređuju s primjerima iz prakse, te se ukazuje na pravne probleme koji su uoćeni pri primjeni Konvencije. Nakon Haške konvencije, a u cilju unapređivanja rješavanja problema izvanugovorne odgovornosti za štetu u prometnoj nezgodi uveden je sustav Zelene karte i Kretski sporazum koji bi trebali olakšati rješavanje problema naknade štete u prometnoj nezgodi s inozemnim elementom. Razmatraju se i poteškoće vezane uz europsko izvješće o nezgodi te suradnja među osiguravajućim društvima, glede učinkovitijeg rješavanja odštetnih zahtjeva oštećenih u prometnim nezgodama s inozemnim obilježjem.

The non-contractual civil legal responsibility for damage occurring in traffic accidents is legally complex. It is necessary to resolve a range of problems which the Hague Convention on the Law Applicable to Traffic Accidents of 1971 tried to answer.

The provisions of the Convention are analysed as are the position of the injured party and the claim for damages. The conventions’ solutions are compared with those in practice and reveal the legal problems noticeable in the application of the Convention.
After the Hague Convention, in the aim of improving the resolution of the problem of noncontractual responsibility for damages in traffic accidents, the Green Card system and the Crete Agreement were introduced. These were supposed to facilitate the resolution of the problem of damages in traffic accidents involving foreigners or a foreign country.
The difficulties tied to the European Report on accidents and the cooperation among insurance companies are studied in relation to the effective resolution of the compensation claims of injured parties in traffic accidents involving foreigners.

The proofs of existence of an international document is the of- ficial licence plate of the vehicle that is normally stationed on the territory of the country whose national bureau has signed the Multilateral Agreement (EEA member countries and other associate countries), and a valid Green Card issued for the vehicle that comes from the coun- try whose national insurance bureau is not a signatory to the Multilateral Agreement (member countries of the ‘Green Card Insurance System’, signatories to the Crete Agreement) and other documents and proofs which validity is recognised by the Croatian Insurance Bureau.
