Inability to pass title in conformity with the express or implied terms of the contract

etterfølgende vanhjemmel - title becomes defective after the contract is signed but before delivery or taking possession of the property sold
opprinnelig vanhjemmel - defective title already in existance when contract is signed
partiell vanhjemmel - seller passes on good title to buyer but title is encumbered by rights of a third party making rights less valuable that buyer would have thought
total vanhjemmel - someone other than the seller owns the property
